An Opioid Criminal Defense Lawyer Breaks Down Opioid Crimes in Texas

An Opioid Criminal Defense Lawyer Breaks Down Opioid Crimes in Texas

As opioid criminal defense lawyers in Texas, we at Gallian Firm all acknowledge that the opioid crisis is one of the most serious public health issues facing the United States today.  In Texas, the opioid epidemic has resulted in a dramatic increase in opioid-related deaths, overdoses, and criminal activity.

Texas Laws to Curb Opioid Crimes are Harsh and Can Be Extreme

In response, Texas lawmakers have enacted a number of laws aimed at curbing opioid trafficking, possession, and intent to sell. While these laws are beneficial, they also make it more likely for individuals to be charged with a crime related to opioids and face serious prison time. Many of those charged with an opioid offense are either innocent or do not deserve to be punished in any extreme manner, often with a goal of being “made an example of”.  Our job as Dallas drug defense lawyers is to defend our clients with passion, integrity, and aggressiveness to get their charges reduced or dropped wherever possible.  It is not relevant whether the drug may be opioids, marijuana, heroin, or other drugs.

As the best drug crime defense attorneys in Texas, part of our job at Gallian Firm is to help our clients understand the laws and implications of being charged with an opioid-related crime and to know when to seek assistance from an experienced opioid drug defense lawyer.

Charges for Opioid Trafficking, Possession, or Intent to Sell

The Texas Controlled Substances Act is the main legal document that outlines the offense of opioid trafficking, possession, and intent to sell. According to the act, a person may be charged with opioid trafficking if they knowingly or intentionally sell, deliver, or possess with intent to deliver a controlled substance. This includes the sale, transfer, or delivery of any opioid, including heroin, fentanyl, and prescription opioids. Depending on the amount of opioids involved, a conviction for opioid trafficking can result in a prison sentence of 5 to 99 years.

Possession of Opioids with Intent to Deliver

Similarly, the Texas Controlled Substances Act also outlines the offense of possession of a controlled substance with intent to deliver. This is a serious crime and can result in a lengthy prison sentence if convicted. Under Texas law, a person can be charged with intent to deliver if they knowingly possess a controlled substance with the intent to transfer or deliver it to another person. Depending on the amount of the drug involved, a conviction for possession of a controlled substance with intent to deliver can result in a prison sentence of 2 to 10 years.

Texas Penal Code Further Outlines Penalties that Are Relevant to Opioid Crimes

In addition to these two laws, the Texas Penal Code also provides for the offense of possession of a controlled substance. This law states that a person can be charged with possession of a controlled substance if they knowingly possess any amount of a controlled substance without a valid prescription. Depending on the amount of the drug involved, a conviction for possession of a controlled substance can result in a prison sentence of 180 days to 2 years.
